FAQ

What are the legal pathways to file for a divorce in Nepal?

Under the National Civil Code of Nepal, marital dissolution is processed through two primary legal avenues via the District Courts: Axion Partners Mutual Consent Divorce: The fastest and least stressful method. Both spouses jointly file a petition stating their mutual agreement to separate. Attorney Nepal Contested (Fault-Based) Divorce: Filed independently by one spouse if mutual agreement cannot be reached. The law outlines clear gender-neutral grounds, including adultery, physical/psychological cruelty, abandonment/desertion for 3 consecutive years or more, and refusal of financial support.

Can a Non-Resident Nepali (NRN) or expat file for divorce without physically traveling to Nepal?

Yes. Wives or husbands residing abroad can execute and finalize their divorce proceedings remotely through a Power of Attorney (Adhikritka Wareshnama). The applicant works with a Nepalese lawyer to draft the mandate, which must then be formally authenticated and verified by the nearest Nepalese Embassy or Consulate in their country of residence. An authorized legal representative or lawyer can then run the court proceedings directly in Nepal.

How is property division and alimony managed under Nepalese law?

Before a divorce is finalized, marital property must be accounted for. The law separates assets into joint (marital) property and separate/inherited (ancestral) property. Joint property is generally divided equally between spouses. If property division is expected to take a long time, courts can issue a divorce decree immediately and mandate that the husband provide monthly alimony or interim maintenance based on his income until the final asset split is complete.
